QVHA Governing Documents and Utah State Code
In order to serve on the QVHA Board effectively and without putting the HOA at risk of litigation and excessive legal bills, each Board member must know and be willing to abide by the stipulations and requirements of the HOA Governing Documents (CC&Rs) and applicable Utah State Code. Both have strict legal parameters regarding the actions of Board members.
The newly formed Legal Advisory Board may prove to be helpful in stemming the practice of turning to legal advisers too soon or unnecessarily.
Every question raised by members of the Association can and should be answered by turning to these contractual and legal documents. Only after a thorough scrutiny of these documents when no answer emerges, should legal counsel be considered or sought.
